Rule 40
Complaint about promotion
(1) According to the prevailing law related to the service group, the potential candidate who is not satisfied with the promotion recommendation made by the relevant promotion committee, within the time limit specified in the law related to the relevant service condition, the complainant himself must appear and attach the document specified by the commission, including the clear grounds and proof that he should be promoted. Complaint can be filed with the Rakhi Commission.
(2) Notwithstanding anything written in sub-rule (1), if the complainant is unable to attend the commission in person to file the complaint, any civil servant may file the complaint that the complainant wishes to file with the commission, stating the reason. However, the employee who brings the complaint to the commission must authenticate and stamp it before the commission stating that the complaint and signature belong to the concerned complainant.
(3) In case of a complaint against the promotion in accordance with sub-rule (1) or (2), the commission will make a decision regarding such promotion complaint by requesting the promotion committee's secretariat including the response of the promotion committee, the personal details of the person recommended for promotion and the complainant, the performance evaluation form and other related necessary documents. .
(3A) Notwithstanding anything written elsewhere in this regulation, the Commission shall not make a decision until at least seven days after receiving the details and documents as per sub-rule (3).
(4) According to sub-rule (3), the decision made by the commission shall be sent to the secretariat of the concerned promotion committee for implementation.
